ON PROTECTION OF TAX INTERESTS OF THE STATE
AND
ABOUT PAYING ME COMPENSATION
Dear employees of the Government of the Russian Federation!
As the Office of the Federal Tax Service of the Russian Federation for the Rostov Oblast informed me (letter dated December 23, 2021, number 23-16 / 3267@), my "ownership right" to the object of real estate "was terminated on June 3, 2019".
This argument is confirmed by responses from the other tax authorities and the Ministry of Finance of the Russian Federation (listed below), as well as by the reply of the Department of State Registration of Rights of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Oblast dated April 08, 2022 No. 15-1329/22.
This is an object located at:
Rostov-on-Don, Muskatnaya Street/Dnepropetrovskaya Street, 32/34, with cadastral number 61:44:0000000:83514 (hereinafter, the term "object" may be used).
The "termination" of property rights is a relevant legal constitutional precedent of national importance.
In connection with the loss of my rights on the object of real estate, I ask you to take the following measures.
First. Vigorously and effectively to fulfil protection of the tax interests of the state.
The object (previously owned by me) at the moment - as I understand it - is not an object of tax accounting. Because of this, the relevant taxes cannot be assessed. According to my preliminary calculations (I am not a professional who is in a paid service in the tax authorities), there is an underpayment of tax.
("According to my unqualified calculations, my non-payment (in full) of the property tax on individuals in 2021 in connection with the "disappearance" of the above-mentioned object is 6633 (six thousand six hundred thirty three) rubles." - my statement dated November 30, 2021, sent to the Federal Tax Service of the Russian Federation (Moscow) on November 30, 2021).
Second. Civil Code of the Russian Federation, article 235, establishes the grounds for termination of property rights). In the moment of "termination on June 3, 2019" of my ownership on the above-mentioned property there were not any case (not a single reason) - from among those provided for by the Civil Code of the Russian Federation (Article 235).
There was no penalty, no wrongful possession, no seizure of land, no redemption of cultural property, no requisition, no confiscation, no "other cases", no seizure in case of corruption...
Thus, I am deprived of object of real estate (almost three years ago) illegally - without legal grounds.
Article 52 of the Constitution of the Russian Federation: "The state provides ... compensation for the damage caused."
(I have been informed by the state authorities of my right to collect the necessary documents, to submit documents for the (new) registration of the (new) ownership.
There are already at least two court decisions on this property, this is an object that brings me anxiety, a time costs, and not benefits and income, and I do not consider it appropriate to exercise the right to submit documents for a (new) registration of (new) right of ownership ).
I ask you to pay me fair and legal compensation, as established by the Constitution of the Russian Federation.
Against the transfer of real estate objects located at the address Rostov-on-Don, Muskatnaya Street/Dnepropetrovskaya Street, 32/34, with cadastral number 61:44:0000000:83514 to federal or regional (or city) ownership - I have no objection. I express my consent to this - provided that I receive fair and legal compensation.
Third. Not being the owner, I cannot be held responsible for this property. I suppose that the requirements of ensuring public safety as well as the economic interests of the state make it necessary to organize the protection of the specified object.
(The economic interests of the state are mentioned here, since, according to my assumptions, after the payment of compensation, the object will become federal or oblast property).
I already wrote about the need to organize the protection of this object in my statement dated April 11, 2022 to the Ministry of Finance of the Russian Federation.
Please check whether appropriate measures have been taken in the interests of public safety.
In connection with the above,
I PLEASE the Government of the Russian Federation:
1. Take energetic and urgent measures to protect the tax interests of the state (for tax accounting of an actually existing property, for tax assessment (if there are grounds), for full payment of tax (if there are grounds)..
2. Take measures to pay me compensation in connection with the losses incurred by me - due to the termination of the ownership of the above-mentioned object.
3. Take measures to protect the above-mentioned object - in the interests of public safety.
